Elon Musk sought help from fellow tech giant Mark Zuckerberg in his $97.4 billion bid to buy OpenAI earlier this year.

OpenAI – the owner of ChatGPT – revealed how the world’s richest man had communicated with the Meta CEO about possible financing arrangements or investments in connection with his OpenAI bid, but Zuckerberg did not come on board.

According to a court filing, OpenAI said that Musk had revealed his communication with the Facebook chief about the firm during sworn interrogations.

The artificial intelligence (AI) company has requested a federal judge to order to Meta to produce documents and communications related to any takeover bid and those “concerning any actual or potential restructuring or recapitalisation of OpenAI”.

OpenAI added: “Meta’s communications with other bidders, or internal communications, including those reflecting discussions with Musk or other bidders, would also shed light on the motivations for the bid.”

In the same court filing, Meta said that OpenAI should seek relevant documents directly from Musk and his AI startup xAI and asked the judge to deny OpenAI’s motion.

The tech giant added in the court filing: “Meta’s own communications concerning OpenAI’s restructuring or recapitalisation (even as narrowed) are not relevant to this action.”

Musk has not commented on the matter.

Earlier this month, US District Judge Yvonne Gonzalez Rogers ruled that Musk has to face OpenAI’s claims that he attempted to harm the company through press statements, legal claims and a “sham bid for OpenAI’s assets”.

Tesla boss Musk took legal action against OpenAI and CEO Sam Altman last year due to the company’s transition to a for-profit model before OpenAI counter-sued the billionaire in April.

A jury trial is scheduled to take place in spring 2026.
