The Cosby Show actor accidentally drowned while on vacation in Costa Rica on 20 July, 2025, and now Tenisha Warner – who married the late star in 2022 and has a nine-year-old daughter, MacKenzie with him – has filed two lawsuits against Pamela Warner, who serves as successor trustee of her son’s Warner Family Trust.
According to legal documents obtained by Entertainment Weekly, Tenisha has claimed she is owed $1 million in life insurance obligations, $50,542.46 for anniversary payment obligations, $30,500 for a ROTH IRA obligation, and a $195,000 salary obligation for her employment as Malcolm’s “chief of staff.”
Arguing she is entitled to the money according to a pre-marital agreement, she claimed in her first lawsuit, which was filed in Los Angeles County Superior Court on 17 July: “Malcolm provided for his family during his lifetime, and intended to provide for them in the event of his death. Unfortunately, Malcolm’s intent has been thwarted by an outdated revocable trust, the Warner Family Trust, dated October 7, 1996.”
The Trust divides the actor’s estate between his mother, father, and half-sister, which “effectively disinherits his nine-year-old daughter, MacKenzie, and his widow, Tenisha, from the entirety of the 1996 Trust, and leaves them without adequate financial support… This was not Malcolm’s intent.”
A second lawsuit was filed on the one-year anniversary of Malcolm’s death in DeKalb County, Georgia, where he lived, and alleged breach of contract against Pamela in her capacity as trustee of her son’s estate, and requested a declaratory judgment to settle the ongoing dispute.
Tenisha has insisted her husband “had every intention” to provide for her and their daughter before his death and had sought to make a new plan for his estate before his death at the age of 54, but was ultimately “unable to do so before we lost him”.
She told People magazine in a statement: “For the last year, I have attempted to privately settle my beloved husband’s complicated estate and honour his last wishes.
“Malcolm had every intention to provide for our nine-year-old daughter and me.
“He was close to finalising a new estate plan to replace the stale plan created in 1996 when he was 26 years old, 20 years before we met and well before we gave birth to our beautiful daughter…
“I have been struggling to care for our daughter as a single mom and now as her sole provider.
“Legally, I had no choice but to take action to protect our rights before any potential statute of limitations expired. We thank you for your support, love and understanding as we work through this painful process while honoring Malcolm’s life on the first anniversary of his death.”
Pamela had hinted at the dispute in a social media post on Instagram as she reflected on the “year of pain, hurt, loss, emotional destabilisation” since losing her son.
She wrote: “During my year long journey, I have discovered how cruel, evil and greedy a human can be.
“I have also discovered the depth of love, care, concern and support that humans are capable of. All of which I have been the recipient of. The good, the bad and the ugly. These are the lessons that apparently I will need as I continue my journey.”
