Nintendo has reached a settlement with Genki over the company’s Switch 2 mockup at CES 2025.
The gaming giant sued the accessories manufacturer for trademark infringement in May after it shared renders of a Switch 2 “mockup” months before official images were revealed by the publisher.
Now, a US judge has ordered the company to pay damages as part of a settlement.
Under the ruling, damages must be paired, while Genki has denied obtaining a Switch 2 before the reveal or launch.
The company also faces a permanent injunction which will prevent it from using any of Nintendo’s logos or designs, or anything which could cause confusion.
Furthermore, terms like Glitch, Glitch 2, and Genki Direct are banned, while customers must be clearly told that Genki’s accessories are unlicensed.
Visitors at its CES 2025 booth were told the mockup was allegedly based on a genuine system Genki used to develop its accessories.
At the time, Nintendo accused Genki of “embarking upon a strategic campaign intended to capitalize on the public interest surrounding Nintendo’s next-generation console”.
The company faced allegations of trademark infringement, false advertising and unfair competition.
Nintendo claimed the firm “boasted its alleged early access to the unreleased console and allowed guests to hold and measure the mockups”.
They insisted Genki “misled and is misleading the public” by claiming compatibility, which would be “impossible to guarantee without unauthorized, illegal early access” to the console.
As reported by IGN, court papers said: “Following its initial claims of access to a genuine Nintendo Switch 2 console, Defendant’s statements were contradictory and inconsistent, with Defendant later stating that it was never in possession of a console.
“Nevertheless, Defendant has since maintained its representation to consumers that its accessories will be compatible with the Nintendo Switch 2 upon the console’s release.”
