Halle Berry lands restraining order after ex claims she abused their 12 year old son

Halle Berry’s ex Olivier Martinez has been granted a temporary restraining order against her after making allegations that she physically abused their 12-year-old son Maceo.

The 60-year-old Hollywood star’s attorney has described the lawsuit as “entirely meritless and deliberately misleading”, while a Los Angeles County judge has granted a temporary restraining order against the actress.

As reported by PEOPLE magazine, the judge has ordered a temporary modified visitation, noting that partial custody should be “continued to maintain communication between [Berry] and [Maceo]”.

The judge also denied a request for Berry’s sobriety to be monitored due to “insufficient information”.

In his October 1 petition Martinez, also 60, alleged that Berry caused him “emotional and mental distress due to physical abuse of our minor child, Maceo”.

He claimed she “grabbed Maceo by the neck and started choking him while shouting, ‘Who is dominant now?! Who is dominant?'”

Martinez has also accused Berry of “instances of abuse over the course of the last few years,” alleging that there have been “additional physical attacks against our son, as well as verbal and emotional abuse from Petitioner to me”.

The temporary restraining order will remain in effect until a hearing on October 16, where it will be determined whether or not the order will be made permanent.

The order has modified the hours of Berry’s visitations, limiting her time with Maceo to Mondays and Tuesdays, and Saturdays and Sundays, between 10am and 8pm.

The couple finalised their divorce in 2023, after an eight-year legal battle.

This week, Martinez’s lawyer Patrick Baghdaserians, who described the man as a “loving parent”, has claimed his “paramount concern” is their child’s “health, welfare” and “safety”.

He added: “The second concern would be for mother to get the appropriate help that she needs to address her issues so she can better herself, which would in turn help the minor child moving forward.”

In a statement to Entertainment Weekly, Berry’s attorney Marina Beck has described Martinez’s decision to file the lawsuit as “outrageous conduct”.

She said: “To say this filing is entirely meritless and deliberately misleading would be an understatement.”

She has also accused Martinez of being “erratic” and possessive”, as well as having “violated court orders and interfered with therapeutic and educational interventions” involving Maceo.

The lawyer added: “Fortunately, Halle is used to this kind of outrageous conduct from Mr. Martinez and, while she is deeply saddened, she will not allow it to deter her from fighting for Maceo’s best interests and providing him with the love and support he needs.”
